Trading digital assets involves substantial risk of loss. You should carefully consider whether trading is suitable for you in light of your financial situation, investment objectives, and risk tolerance. Potential risks include:

  • Price volatility and potential for significant losses
  • Market manipulation and fraud
  • Regulatory changes that may affect the value of digital assets
  • Technical issues, system failures, or cyber attacks
  • Loss of private keys or access to digital wallets

7.2 No Investment Advice

8. Limitation of Liability

To the maximum extent permitted by law, AsterDex and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or digital assets, arising out of or relating to your use of our Services.

Our total liability to you for any claims arising from or related to our Services shall not exceed the amount of fees you paid to us in the 12 months preceding the claim.

You agree to indemnify, defend, and hold harmless AsterDex and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to:

  • Your use of our Services

10. Suspension and Termination

  • We are required to do so by law or regulatory authority
  • There is suspicious or fraudulent activity

10.2 Termination

You may terminate your account at any time by contacting our support team. We may terminate your account at any time, with or without cause, with reasonable notice. Upon termination:

  • Your right to use our Services will immediately cease
  • We may cancel pending transactions
  • You must withdraw any remaining funds within 30 days
  • We may retain certain information as required by law

11. Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

11.2 Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or our Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in San Francisco, California.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of our Services after such changes constitutes your acceptance of the modified Terms.

14. Severability
